Bones goes to court probably more than most procedurals, but I can't remember the last time it happened. The Gravedigger, who was caught rather randomly the last time we saw her, is up for trial and the evidence against her isn't strong. They get new evidence which could be very helpful, but so they can work on the case, the charges against her for the kidnapping of Brennan, Hodgins, and Booth must be dropped so there isn't a conflict. They prosecute a boy's murder instead and after a few setbacks on the witness stand and a compelling speech by the Gravedigger, a guilt verdict comes back.
Max wasn't really needed, but he added additional flavor to the episode with his perspective on the law and his semi-friendly relationship with Booth. Primarily, the episode was built on everyone dealing with their lingering feelings about the case and the strength of the characters shone through.
There are rumors flying around, so here's what I think will happen in the season finale. Brennan will quit her job at the end of the season, and Season 6 will start with a time skip. Once again we can berate Hart Hanson for lying and prolonging the sinking sink that is Brennan and Booth. Given the trajectory the show has taken, I'm guessing the series finale will be them getting married. Yeah, it's boring, predictable, and for Hart, great television.
